We, the company lizengo GmbH & Co. KG, take the protection of your personal data and the statutory obligations that serve this protection very seriously. The statutory provisions require comprehensive transparency regarding the processing of personal data. You are only sufficiently informed about the purpose, nature and scope of the processing if the processing is comprehensible to you as the data subject.

Our privacy policy therefore provides you with a detailed explanation of the personal data that we process when you use our website (www.lizengo.co.uk), all other sub-pages which make reference to it and in other cases which are possibly explained below.

2.1. From the GDPR

This privacy policy uses the terms in the legal text of the GDPR. Definitions of the provisions (Art. 4 GDPR), are available, for example, at https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A32016R0679.

2.2. Cookies and similar technologies

Cookies are text files that are stored by a website on your end device and/or read out there. They contain combinations of letters and numbers, for example, to recognise the user and their settings when they make another visit to the website which originally placed the cookies, to enable the user to remain logged in to a customer account, or for the statistical analysis of specific user behaviour.

WebStorage technology enables variables and values to be saved locally in the browser cache of the user. This technology includes what is known as the "sessionStorage", which remains stored until the browser tab is closed, as well as the "localStorage", which is stored in the cache of the browser until the cache is cleared by the user. Among others, the localStorage technology allows for user and their settings to be recognised when they visit our website.

2.3. Data categories

When we the make reference to the processed categories of data, this includes the following data in particular: master data (for example, name, address, date of birth), contact data (for example, email addresses, telephone number, messenger services), content data (for example, text entries, photographs, videos, contents of documents/files), contract data (for example, subject matter of the contract, durations, customer category), payment data (for example, bank details, payment history, use of other payment service providers), user data (for example, use of our website, use of specific content, times of access, contact or order history), connection data (for example, device information, IP addresses, URL referrers), location data (for example, GPS data, IP geolocation, access points).

3. Information on data processing

We only process personal data if we are legally permitted to do so. Personal data is only forwarded to third parties in the cases outlined below. Personal data is protected with appropriate technical and organisational measures (for example, pseudonymisation, encryption).

Unless we are legally obliged to store or forward personal data to third parties (in particular, law enforcement agencies), the decision on which personal data is processed by us and for how long, and the extent to which we disclose such data, if any, depends on the specific functions of the website you use in each individual case.

4. Retention period

The personal data will be erased as soon as the purpose of the processing lapses or a prescribed retention period expires, unless the continued retention of the personal data is required for entering into or fulfilling a contract. Insofar as we are required to inform you about the retention periods for cookies and similar technologies, the applicable information is provided at the end of this privacy policy (see ‎III.).

Personal data that we process in the scope of an application (see below) will be stored for a period of six months after the application process is complete. 

5. Automated individual decision-making including profiling

Automated decisions in individual cases, including profiling, are made exclusively for the following processing activities:

• credit checks for payment on account (see the information under Section II. "ADU-Inkasso" and "Klarna")

These decisions are valid as they are necessary for entering into or performing a contract between you and us.

We will take suitable measures to safeguard your rights and freedoms as well as your legitimate interests, which at least entails the right to obtain intervention by an individual person on our part, to express your point of view and to contest the decision.

Such decisions are not based on special categories of personal data according to Art. 9(1) GDPR.

6. Rights of data subjects

As a data subject, you have the right of access pursuant to Art. 15 GDPR, the right of rectification pursuant to Art. 16 GDPR, the right to erasure pursuant to Art. 17 GDPR, the right to the restriction of processing pursuant to Art. 18 GDPR, as well as the right to data portability pursuant to Art. 20 GDPR. The rights of access and erasure are governed by the restrictions according to Sections 34 and 35 BDSG.

You have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR in connection with Section 19 BDSG).

7. Notification obligations of the controller

We shall communicate any rectification or erasure of your personal data and/or a restriction of processing in accordance with Article 16, Article 17(1) and Article 18 GDPR to all recipients to whom the personal data has been disclosed, unless such communication is impossible or involves a disproportionate workload. We shall inform you about the recipients upon your request.

8. Obligation of provision

Unless explained otherwise in the information on the legal bases below, you are not obliged to provide personal data. In the cases of point (b) of Art. 6(1) GDPR, however, the personal data are required for the performance of a contract or the conclusion of a contract. If you do not provide the corresponding personal data, the performance or conclusion of the contract will not be possible. If you do not provide the data in the cases of points (a) and (f) of Art. 6(1) GDPR, you will not be able to use the affected parts of our website. 

9. Right to object and withdrawal of consent

On grounds relating to your particular situation, you have the right to object to the processing of your personal data which occurs on the basis of point (f) of Art. 6(1) GDPR at any time. If personal data are processed for the purposes of direct marketing, you have the right to object to the processing of your personal data for the purposes of this marketing at any time.

According to Art. 7(3) sent. 1 GDPR, you have the right to withdraw any consent you have previously granted us at any time. In doing so, the lawfulness of the processing that occurred on the basis of the consent until the time of its withdrawal shall not be affected. Therefore, the withdrawal only applies to processing which is planned to occur after the withdrawal. Informal withdrawal is also possible by post or email. If you submit an objection, we will no longer process your personal data unless another (statutory) basis allows us to do so. If you withdraw your consent and there is no statutory basis that permits otherwise, the personal data must be erased immediately at your request pursuant to point (b) of Art. 17(1) GDPR.
